Terms of Service
Changes in this version: how Founding seals are numbered, and what happens if all are taken or a purchase is refunded (section 5.1).
1. Agreement
These Terms of Service (“Terms”) are a legal agreement between you and Andrija Bogdanović, an individual developer based in Serbia (“we”, “us”), governing your use of the Habit Cultivator mobile application and related services (“the App”).
By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. What Habit Cultivator is
Habit Cultivator is a habit-tracking application presented through the fiction of xianxia cultivation. You create “disciplines” (habits), mark them complete, and the App represents your consistency as progress, Qi, realms and streaks.
It is a productivity and motivation tool. It is not:
The in-app world (realms, sects, spirit stones, oaths, demons) is fiction. In-app currency and items have no real-world monetary value, cannot be exchanged for money, and cannot be transferred between accounts.
3. Your account
The App can be used in two ways, and the difference decides what we can do for you.
Guest account (the default). You can start without giving us anything. The account is created automatically and has no email address and no password.
Named account. You may add an email address and password at any time (Profile → Bind account), or at the start. It is the same account — nothing is migrated and no progress is lost.

Sect names and notices are visible to other users. We may remove content and suspend accounts that violate this section.
Reporting and hiding. You can report a sect name, a sect notice, a member’s name, or the partner in a pact or a bond from inside the App (the Report action next to the content, or ⋯ on a member’s row). A report sends us a copy of the text as it was at that moment; we review reports within 48 hours and may remove the content, remove the member from the sect, or suspend the account. The person reported is not told who reported them. You can also hide another user: their name and notices stop appearing to you, no new pact or bond can be formed between the two of you, and an active bond between you ends. A sect founder can remove a member from the sect. Before you first create or join a sect, post a notice, or offer or accept a pact or a bond, the App asks you to accept these Terms.
5. Paid features (Patron)
Basic use of Habit Cultivator is free. Optional paid plans unlock cosmetic themes (“Celestial Skins”) and Patron benefits.
5.1 Plans
Prices are indicative; the price shown in the store at the moment of purchase applies, and may vary by country and local taxes. Founding Patron is limited to the first 100 buyers and may be withdrawn or repriced afterwards; purchases already made are not affected.
Founding seals. Each Founding Patron purchase that the store confirms receives one numbered Founding seal. Our server assigns the numbers in the order in which purchases are confirmed, and other members of your sect can see your number. We withdraw the offer shortly before the last seal is taken, so that purchases already in progress can still receive one. If a purchase is nevertheless confirmed after all seals are taken, you keep lifetime Patron access without a seal, and you can ask us for a full refund. If a Founding Patron purchase is refunded or reversed, its seal and the title that comes with it are removed, and that number is never given to anyone else.

Manage or cancel any time:
Cancelling stops future renewals. You keep Patron access until the end of the paid period. Deleting the App does not cancel a subscription.
5.4 Refunds
Refunds are handled by the store under its own policy (Apple Media Services Terms / Google Play Terms of Service). We generally cannot issue refunds directly, but if something went wrong, email us and we will help where we can.
EU/EEA withdrawal right: where a statutory 14-day withdrawal right applies to digital content, that right is exercised through the store from which you purchased.
5.5 What paid access includes
Patron benefits are cosmetic and convenience features (themes and Patron marks). Free users retain full access to core habit tracking. Paid features never make core habit tracking unavailable.
6. Availability, changes, and beta features
7. Your content
You keep ownership of the content you create (habit names, notes, sect names). You grant us a limited licence to store, process and display that content solely to operate the App — for example showing your cultivator name to your sect. This licence ends when you delete the content or your account.
8. Our content
The App, its name, logo, artwork, themes, text, mechanics and code are owned by us and protected by copyright. Xianxia genre concepts (cultivation, qi, realms, sects) are traditional and generic, and are used here as genre conventions; the App is not affiliated with or endorsed by any novel, game, anime or other franchise.
You may not copy, modify or distribute the App or its assets except as permitted by law.
9. Termination
You may stop using the App at any time and delete your account (Profile → Settings → Delete account).
We may suspend or terminate an account that violates these Terms, harms other users, or is required to be removed by law or by a store. Where reasonable, we will warn you first. If we terminate your account without cause while you hold an active subscription, you may request a pro-rata refund of the unused period through the store.
10. Disclaimers
The App is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law, including fitness for a particular purpose or that use of the App will produce any particular result — including forming, keeping or improving any habit.
Nothing in these Terms excludes liability that cannot be excluded by law, including your statutory consumer rights.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential damages, lost profits, or lost data arising from your use of the App.
Our total liability for any claim relating to the App is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) €50.
This does not limit liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.
12. Data protection
Your privacy is covered by our Privacy Policy: https://habitcultivator.com/privacy — which forms part of these Terms.
13. Changes to these Terms
We may update these Terms. For material changes we will notify you in the App or by email before they take effect. Continuing to use the App after the effective date means you accept the updated Terms. If you do not accept them, stop using the App and delete your account.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. Disputes are subject to the competent courts in Belgrade, Serbia.
If you are a consumer in the EU/EEA, this choice does not deprive you of the protection of mandatory consumer-protection rules of your country of residence, and you may bring proceedings in your local courts.
